What Happens After an Arrest?
After an arrest has been made the defendant will be taken to a local city jail or the county jail. Once at the jail, the defendant will go through the booking process. This includes several steps including:
- Identity verification
- Photograph or mug shot
- Property inventory
- Formal charges
- Bail determination
At all jails the booking in process usually takes between 2 and 5 hours to complete. As soon as the booking process is completed, the bond is posted and the defendant then begins the release process. If held at any one of the city jail’s, like Anaheim Jail, Newport Beach Jail, Huntington Beach Jail, etc., defendants are released quickly after bond is posted. If held at the Orange County Jail, this usually takes between 3 and 8 hours or longer depending on the activity inside the jail or other factors.
All parties are explained their rights and responsibilities before signing the bail bond agreements. Our primary concern and responsibility is for the defendant to appear at every court hearing that is scheduled for their case. If for any reason the court believes the defendant has left the area or is planning on skipping their court hearings, they may choose to revoke their bond. An arrest warrant will be issued and they will be returned to the jail. If they are not returned to the jail, their bond will be forfeited and the co-signer will be financially responsible for the entire amount. If the co-signer no longer wishes to be held responsible, they can revoke the bond themselves and remove their financial obligation. The defendant will then be returned to custody to await their hearing.
